INFORMATION ON THE PROCESSING OF PERSONAL DATA (ARTICLES 13 AND 14 GDPR)

Dear User, You find here some information regarding the processing of personal data performed through our website www.risattiglobal.com (hereinafter the “Site”), or otherwise carried out in connection with the use of our products and services, pursuant to Regulation (EU) No 2016/679 (hereinafter the “Regulation” or “GDPR”). The data controller is the company Risatti Instruments S.r.l. (hereinafter, “Risatti Instruments”, “we”“our” or the “Company”), strada Goretta nº 92/n, 10074 Mappano (TO), P. IVA, contactable at privacy@risattiglobal.com (hereinafter, only the “Data Controller”“Risatti Instruments” or the “Company”). We are providing this information not only to fulfil our legal obligations regarding the protection of personal data as set out in the GDPR, but also because we believe that the protection of personal data is a fundamental value of our business activity, and we want to provide you with all the information that can help you protect your privacy and control the use that is made of your data.

Categories of personal Data processed

In order to enable the conclusion and establishment of the contractual relationship with Risatti Instruments or when you visit, consult, request or use the services and/or products of Risatti Instruments we collect and use your personal data (i.e. any information that is able to identify you directly or indirectly). We list below the categories of personal data about you that we process:
  • Identification, contact and access data, such as name, surname, username, email address, postal address, telephone number, or user name and password, profile picture if any, if set by you;
  • Product data such as data relating to products licensed to you and/or services subscribed to by you;
  • Billing and payment information, such as VAT number, tax code, address, company name, if any;
  • Browsing data, such as connection data; IP addresses, domain names and other parameters relating to the browser and operating system used by you; log data; data relating to registrations made, interaction and transaction processes, performance indicators; data relating to navigation flows and page views; usage and functionality counts;
  • Usage Data of the services provided by Risatti Instruments. The Usage Data relating to the different products and/or services purchased by you) may be interconnected for lawful and transparent purposes, listed in the following paragraph.

Purpose of processing

The processing of the categories of personal data listed in the table above is carried out by the Company, in the performance of its economic and commercial activities, for specific purposes, as better described below.
  1. Contractual and legal purposes

a. Allow you to browse the Site;

b. Account registration and management (including account verification and credential recovery, where applicable) and use of account features;

c. Carrying out the activities necessary for the conclusion and execution of the contract for the purpose of providing the service/product requested or purchased by you, including through the Site;

d. Handling requests for webinars and event registrations, formulating quotes, processing orders, providing assistance and support;

e. Handling of any complaints and requests, sending of service communications and updates, both through traditional communication tools such as paper mail and through remote communication tools such as email, chat, telephone, SMS, chatbots, banners, notification systems and other remote communication tools;

f. Activities of customer assistance and support to the use of the Services by individual Customers of management of tickets opened for assistance purposes, also through the Usage Data;

g. Fulfilment of obligations arising from applicable law, regulations or EU legislation (e.g. tax and accounting obligations) or management of and response to requests from competent administrative and tax authorities as well as judicial authorities.

The purposes listed above are jointly referred to as “Contractual and Legal Purposes” and no express consent of the data subject is required. The provision of your personal data for the aforementioned purposes is necessary and obligatory and in the event of refusal we will not be able to continue the contractual relationship with you and the provision of the services you have requested.
  1. Purposes of Legitimate Interest

h. For statistical and research analyses regarding the products purchased and the services provided to you and the use of the same, also for the purpose of improving and developing the products and services themselves. In compliance with the principle of minimisation, where possible, this activity will take place after anonymisation and aggregation of the data collected;

i. For the evaluation of your satisfaction with the products purchased and the services provided by Risatti Instruments, or the resolution of any difficulties and problems related to their use: e.g. churn prevention initiatives and improvement of the customer experience;

j. To assert and defend the Company’s rights, including in the context of debt collection procedures and the assignment of credits to authorised companies, including through third parties, and to prevent and counter any fraud;

k. To carry out a potential merger, sale of assets, sale of a company, business unit or financial transaction by communicating and transferring data to the third party(ies) involved;

l. In accordance with article 130, paragraph 4 of Decreto Legislativo (Legislative Decree) 196/2003 (“Privacy Code”), you may send marketing communications by e-mail regarding services or products similar to those covered by the contract concluded with Risatti Instruments, it being understood that, at any time, you will have the possibility of opposing the sending of such communications;

m. In order to perform customer segmentation activities, to which it is possible to send communications for Marketing Purposes on the basis of what is indicated in this information notice, based on non-invasive categories of membership, such as, among others, the professional category of membership, the city/province/region in which it is based, the type of product or service purchased. This customer segmentation activity could also be carried out on third party suppliers’ platforms, through interconnection activities with the third-party platform’s own data. In this case, communications for Marketing Purposes will be sent in compliance with the consents expressed by you and in accordance with what is indicated in this information notice. In this context, the data could also be used to detect similar customer profiles.

The described “Purposes of Legitimate Interest” do not require your specific consent as they fall under the exception provided for in Article 6, paragraph 1, letter f) of the GDPR. In any event, in accordance with the GDPR, the Company has carried out a thorough balancing of interests aimed at protecting and guaranteeing the privacy and fundamental rights of the data subjects.

To send you updates on news and commercial offers of Risatti Instruments products and services, also after interconnection of the Usage Data and analysis of your behaviour both with respect to the navigation of the Site and, more in general, to the use of services and products, or to invite you to take part in events, conduct market research or other commercial and customer satisfaction initiatives both through traditional communication channels such as paper mail or telephone call by an operator and through automated communication tools such as email, chat, messages (SMS), chatbots and other remote communication tools.

The processing of your data for “Marketing Purposes” is not compulsory. Your prior consent is therefore necessary, and the Company will ask for it from time to time in the most appropriate form for each of the activities described above. You may revoke your consent at any time without any consequences with respect to your contractual relationship with the Company.

Communication, dissemination and transfer of Data

In compliance with the principle of finality and minimization, your personal data may be communicated to the following third parties who carry out activities functional to those related to the purchased product or service, such as (a) third party suppliers of assistance and consulting services for the Company with reference to the activities of the sectors (by way of example only) technological, accounting, administrative, legal, insurance, (b) companies of the Risatti Instruments group, (c) in cases where the contractual relationship provides for the intervention of commercial partners, the Company may share some of your personal data with its distributors, resellers and partners who are part of the distribution chain of products and services of the Risatti Instruments group; (d) banks and credit institutions; (e) debt collection companies; (f) subjects and public authorities whose right to access your personal data is expressly recognized by law, regulations or measures issued by the competent authorities; (g) potential purchasers of the Company and entities resulting from the merger or any other form of transformation concerning the Company.(h) public databases and credit information systems. These recipients, as the case may be, process your data as autonomous data controllers, data processors or persons in charge of processing. A complete and up-to-date list of the recipients who process your data as data controllers is available on request from the Data Protection Officer, using the contact details provided in this notice.

Transfer of your personal Data outside the EU territory

Notwithstanding the above, your personal data may be freely transferred within the European Union. However, where, for the purposes indicated, the Company needs to transfer your personal data outside the European Union to countries that are not considered adequate by the European Commission (e.g. the United States), the Company will take the necessary measures to protect your personal data, in compliance with the legal guarantees pursuant to the applicable legislation and in particular Articles 45 and 46 of the GDPR. If you would like to receive further information about the guarantees in place and to request a copy of them, you may contact the Data Protection Officer as indicated in this notice.

Methods of Data processing

Your personal data are processed by the Company using electronic and manual systems in accordance with the principles of correctness, fairness and transparency provided for in the applicable legislation on the protection of personal data and protecting your confidentiality through technical and organisational security measures to ensure an adequate level of security. Such processing takes place at the Company’s registered office and/or at the offices of external data processors who process data on behalf of the Company. With reference to the Usage Data, in compliance with the purposes described and, where necessary, with your express consent, the analysis activities may be carried out, also by interconnecting your data relating to the different products and services purchased by you, during the online use of the services themselves. For usage statistics, the Company uses tools that allow the collection of Usage Data. With specific reference to the collection of Usage Data “in the cloud”, among others, the Company uses analytical tools such as:

a. Web and customer analytics;

b. Analytics and document search;

c. Querying and Dashboarding.

Data retention

The data will be retained for the time necessary to achieve the purposes for which the data was collected, as stated in this notice. In any event, the following retention periods will apply in relation to the processing of data for the purposes set out below:

a. for Contractual Purposes and Legitimate Interest, the data are kept for a period equal to the duration of the provision of the services requested by you and for the following 10 years (period in which the statute of limitations accrues for any contractual liability asserted by the customer against Risatti Instruments), except in cases where conservation for a later period is required for possible litigation, requests by the competent authorities or pursuant to applicable law;

b. for Marketing Purposes, the data is kept for a period of 24 months from the date on which the consent is given or renewed on the occasion of the purchase of a new Risatti Instruments product or service or the date of the last contact with you, including, among others, the termination of the contractual relationship, the participation in a Company event, the use of a product or service provided by the Company or the opening of a newsletter (jointly referred to as the “Last Contact”).

Changing choices and withdrawing consent

If you change your mind, you can change your consent for marketing purposes at any time by contacting us in the manner provided in this policy or, if you no longer wish to receive our marketing communications, by using the unsubscribe link available at the bottom of our marketing communications. Failure to grant or withdrawal of consent will not affect the use of our services in any way.

Rights of Data Subjects

In relation to the data processing described in this notice, you may at any time exercise your rights under the GDPR (Articles 15-21) including:
  • receive confirmation of the existence of your personal data and access to their content (right of access);
  • update, amend and/or correct your personal data (right of rectification);
  • request the deletion or restriction of your personal data processed in breach of the law, including data whose retention is unnecessary for the purposes for which the data were collected or otherwise processed (right to be forgotten and right to restriction), unless there is an overriding public interest or a legal obligation on the Company to retain the data;
  • object to the processing, including profiling (right to object), unless there is an overriding legitimate reason for the Company to continue processing;
  • withdraw consent, where given, to marketing activities;
  • to lodge a complaint with the supervisory authority (Garante per la protezione dei dati personali www.garanteprivacy.it) in the event of a breach of the rules on personal data protection;
  • receive an electronic copy of the personal data concerning you, in order to transfer them to yourself or to a different service provider, in cases where the Company processes such data on the basis of your consent or on the basis that the processing is necessary for the provision of the services you have requested and the data are processed by automated means (right to data portability).
Where applicable, pursuant to Article 2-terdecies of the Privacy Code, in the event of your death, the above rights relating to your personal data may be exercised by those who have an interest in your personal data, or are acting as your proxy, or for family reasons worthy of protection. You may expressly prohibit the exercise of some of the rights listed above by those persons by sending a written declaration to the Company at the e-mail address indicated below. The declaration may be revoked or modified subsequently in the same way.

Changes and updates

This information may be subject to change as a result of any changes and / or additions to the law. The changes will be notified to the interested parties and the constantly updated text of the information notice will be available on the website www. risattiglobal.com (section “privacy”).

Processing of personal Data of suppliers and legal representatives

The processing of personal data of suppliers (individuals or sole proprietorships with which Risatti Instruments has contractual relations) and their legal representatives follows the provisions contained in the dedicated information sheet.
