1.Terms and conditions of use

1.a) The Internet site “RISATTI” (hereinafter specified as the “Site”) is owned by RISATTI INSTRUMENTS SRL with registered office in strada Goretta nº 92 / n, 10074 Mappano (TO), VAT no. VAT and CF IT02017370012, registration number in the Turin Company Register: 530619, PEC address of: risatti.instruments.srl@legalmail.it (hereinafter referred to as “Risatti”) 1.b) Information, content and services offered by the Site are electronically accessible starting from the URL address: www.risatti.it, corresponding to the home page (so-called homepage) of the Site and from the alias risatti.it. 1.c) The User acknowledges that access, services and/or use of the Site are subject to full acceptance of the terms and conditions of use set out below. If he does not intend to accept, the visitor is invited not to use the Site and not to download any material from it. Additional terms and conditions other than these may apply to the provision of certain services or the sale of goods or the use of other parts of the Site. 1.d) The use and/or browsing within the Site are to be understood as tacit approval of these General Conditions. 1.e) The User declares to be of age, as well as having the capacity to act necessary to use the Site by accepting these General Conditions and to assume any liability inferring from the use of the Site.

2. Site Services

2.a) Site Services:
  1. a) newsletter including promotional and/or advertising content;
  2. b) downloading and viewing of contents;
  3. c) products presentation.
2.b) Risatti reserves the right in any case to interrupt, at its irrevocable discretion, the provision of the above-mentioned services, to provide new ones, or to modify the performance methods. 2.c) Services are provided by Risatti free of charge (unless otherwise provided for by specific conditions), following the rule of “as is and as available” at the time of its use As for the service referred to the point 2.a – a), information and advertising e-mails are periodically sent to the User, expressing their compulsory consent. The Service may be interrupted at any time (opt-out) and on the occasion of each single sending, by communicating the Risatti’s Site. For more information, please consult the Privacy Policy on the Site itself.

3. Users Commitments

3.a) The User undertakes to use the Site and the Contents in a diligent, correct and lawful manner and in particular, for illustrative, yet incomplete purposes, he undertakes to refrain from:
  • from any improper use of the Site in contrast with the law, the General Conditions and all other indications published on this Site, or contrary to morality and morality;
  • from any action capable of compromising the rights and interests of Risatti and/or third parties, including intellectual or industrial property rights, or of damaging, deteriorating or preventing in any form the normal use of the Site, of the IT media or documents, files and any class of content stored therein;
  • from reproducing, copying, transforming, distributing, making available or disclosing in any other form to other sites or to the public any material and/or information contained on the Site, unless such action has been expressly authorized by Risatti;
  • from sending, providing or in any way publishing in the spaces that may be enabled for this purpose, content which presents findings of a defamatory, slanderous, obscene, pornographic, abusive, sexist, racist, discriminatory or any illegal title, including using the site and its services for fraud or phishing purposes (used to obtain information about the User’s account and password);
  • from sending, disseminating or distributing by any means content including offers with commercial or promotional content of any kind, without the prior written authorization of Risatti.
The User undertakes not to publish any confidential information or information that allows him to be personally identified or to identify third parties, for example by disclosing personal data, passwords, user names, telephone numbers, e-mail addresses.

4. Personal account

4.a) The User may register on the Site to use the products and/or services. The User will have the Login area through which he will be able to access and check the status of the services for which he has requested from time to time. 4.b) By registering on the Site, the User must provide an e-mail address or username (hereinafter the “id”) and a strictly personal access password. Both the id and the password cannot be used by two or more workstations at the same time and the User cannot sell them or transfer them to third parties, even within a group, unless under his full and exclusive responsibility. In this regard, please note that the User will be held liable to Risatti and any third party for any and all actions, transactions and/or events that have occurred and/or carried out through the use of the entered id and/or password. 4.c) The User must preserve the confidentiality and secrecy of his id and password and is required to promptly inform Risatti of any unauthorized use or loss, by e-mail, so that it can suspend the provision of its services regarding the account. 4.d) If an access to the User’s account has occurred and/or the same has lost his ID and/or his Password more than three times, Risatti reserves the right to remove the User’s account without having anything to claim against him. 4.e) Risatti cannot be responsible in any way, directly or indirectly, in any form or on the basis of any liability regime, for damages of any kind, even indirect, resulting from, or related to, failure to comply with part of the User of the provisions referred to in this article. 4.f) Risatti will be free to inhibit a User’s access to its customer area and/or to interrupt the operation of the user’s ID and/or password, if it deems that a substantial violation of these general conditions of use has occurred and, in particular, of what is foreseen, or if the User makes an illicit or incorrect use of the Site services. 4.g) The User will also be required not to carry out or allow third parties conduct that does not comply with the purposes of the service.

5. Linking

5.1) Any form of link to this Site if inserted by third parties must not damage the image and activities of Risatti. “Deep linking” is prohibited, which means  the use, on third party sites, of parts of the Site or in any case the direct link to the pages without going through the home page of the Site. In any case, the creation of links, even where authorized,will not give rise to any liability on the part of Risatti, it being understood that the same reserves the right to request the removal of such links at any time. 5.2) Any non-compliance with these provisions referred to in this article, unless explicitly authorized in writing by Risatti, will be prosecuted in the competent civil and criminal courts.

6. Intellectual/industrial property

6.a) All rights to the contents of the Site (by way of example texts, images, distinctive signs, audio and video files as well as the architecture of the Site itself. The methods of presentation of the information in this) are reserved to Risatti or to the legitimate owners, in accordance with the national and international legislation in force. 6.b) “Risatti” and the relative logo are trademarks registered nationally and internationally owned by Risatti which reserves all use. 6.c) Contents of the pages of the Site cannot, either totally or in part, be copied, reproduced, transferred, uploaded, published, distributed or disseminated in any way without the prior written consent of Risatti, without prejudice to the right of the copy and communication, within the limits established by articles 65 and following of the law of 22 April 1941, n. 633, and the possibility of storing them on computer or printing extracts from the pages of this Site, solely for personal use provided that:
  • no document or graphic element of the Site is modified in any way;
  • no graphic element of the Site is used separately from the reference text;
  • the declaration of copyright and the declarations of registered trademarks or patents (collectively the “Credits”), together with the mention of this license are attached to each copy extracted from the Site.
  • Any copy, paper or digital, of the materials downloaded or printed from the Site cannot be modified in any way, and the separate use of images, photographs, videos, audio, graphics or other with respect to the Credits relating to them is not permitted.
Except as established above, no part of the Site may be reproduced or stored on any other website or included in any system for storing and searching for information or providing services, without the prior consent of the Administrator. 6.d) Any material sent to Risatti for participation in the site services (for illustrative, yet incomplete purposes, to send comments, express opinions, participate in surveys and initiatives, send images or video and audio files), will be considered of nature not confidential, Risatti assuming no liability of any kind in relation to such materials, being able to use them without limits. In particular, the User grants Risatti an unlimited right of non-exclusive use, without limitations of geographical areas or means. Risatti may therefore, directly or through trusted third parties, use, copy, transmit, extract, publish, distribute, publicly perform, disseminate, create derivative works, host, index, store, annotate, encode, modify and adapt (including without limitations the right to adapt for transmission by any means of communication) in any form or with any tool currently known or to be created in the future, every image and every message, including audio and video, that should be sent by the User, including through third parties. 6.e) The material sent will not be returned and will remain the property of Risatti which therefore remains exempt from any responsibility towards the participants for the loss or destruction of the material sent. 6.f) Those who send materials participating in the services of the site guarantee that the same are publishable, accepting and undertaking to indemnify and hold harmless Risatti from any action by third parties in relation to such material or for the violation of the law. For example in the copyright field, or in any case the protection of intellectual property, or in the field of personal data processing. 6.g) The rules specified in this article concern any type of content generated by the User using the services made available by the site. 6.h) Any non-compliance of  these provisions, unless explicitly authorized in writing, will be prosecuted in the competent civil and criminal courts.

7. Warranties and Liability

7.a) Risatti does not guarantee the continuity of access or the correct display, download or use of the elements and information contained in the pages of the Portal, which may be prevented, hindered or interrupted by factors or circumstances beyond its control. 7.b) Information and Contents available on the Site are purely informative and, unless otherwise and specifically provided (eg: commercial offers, discounts, promotions, e-commerce etc.), do not constitute a contractual proposal or an offer to the public. pursuant to art. 1336 of the Civil Code of the products and/or services described, nor can they be considered binding for any negotiation or commercial relationship. 7.c) Under no circumstances will Risatti be held responsible for any direct or indirect damage caused by the use of this site, by the inability or impossibility to access it, by relying on the information contained therein or by their actual use. 7.d) Information can be modified or updated without notice. Risatti may also improve, change or delete some sections of this site, without notice. 7.e) Although services and/or contents of the Site have an indefinite duration, Risatti reserves the right to unilaterally terminate, suspend or interrupt at any time and without notice, the provision of services or the Site in general. The User acknowledges that Risatti will be held in no way liable to users or third parties for the suspension or interruption of its services or the temporary or permanent deletion of the contents. 7.f) The User acknowledges that the Site manager cannot under any circumstances be held responsible for the information, content, products and services offered or provided through the Portal by third parties or entities, including those with whom the Site has activated a link, and for any other content, information or anything else contrary to current regulations present in the resource of the third party linked to the attached link. Anyone who decides to visit an other site linked to the Site does so at their own risk, assuming the burden of taking all necessary measures and precautions against viruses or other destructive elements. 7.g) The User acknowledges and accepts that any contractual or extra-contractual relationship that may be formalized with third parties contacted through the Site, will be carried out solely and exclusively between the User and the third party. Consequently, the User accepts that the Company has no responsibility for any damages of any nature in connection with negotiations, conversations and/or contractual obligations with third parties contacted through the site. 7.h) The connection with other sites does not imply that Risatti sponsors or it is affiliated with the entities that carry out the services described in those sites. 7.i) In no way can Risatti be held responsible for damage caused to third parties due to the erroneous, pernicious and/or unauthorized use of the materials contained on the site, or the transmission of any viruses that infect the IT equipment used by visitors. of the same site.

8. Personal data

9. Cookies

9.a) A “cookie” (a small data file that some websites, while being visited, can send to the visitor’s address) may be located somewhere on the Risatti Site, in order to trace the visitor’s paths on the Site The cookie is transferred to the User’s HD for registration purposes to “memorize” which areas of a website have been visited. This choice allows faster navigation on the site. 10.a) Risatti reserves the right to make, unilaterally and at any time, changes to these General Conditions published on the Site. 10.b) The User is required to cyclically review the General Conditions in force. Changes will become operational when published on the Site. The continued use of the Site by the User, following a change, will be considered as an acceptance of such changes.

11. Law and jurisdiction

Without prejudice to the possible applicability of mandatory rules, the execution and interpretation of these Terms of Use is governed by the Italian law. The Court of Turin (Italy) will have exclusive jurisdiction and competence for any disputes connected to these conditions. Nevertheless, Risatti reserves the right, where necessary, to be able to take legal action before the Courts of countries or cities other than Italy or Turin to protect its interests and enforce its rights.
